TERMS AND CONDITIONS OF SALE

1. ACCEPTANCE OF TERMS Welcome to Tess Mann Atelier. By accessing our website or purchasing a Ready-to-Wear or Made-to-Order garment, you agree to be bound by the following Terms and Conditions. Please read these carefully before placing your order, as they dictate the rules regarding production, alterations, cancellations, and returns.

2. THE MADE-TO-ORDER PROCESS & LOCK-IN DATES Our Made-to-Order gowns are handcrafted specifically for you upon the placement of your order.

  • Lock-In Date: Once your order is placed and measurements are submitted, you have a 48-hour grace period to make any changes to your size, style, or color. After this window, your order reaches its "Lock-In Date" and immediately goes into production.

  • Post Lock-In: No changes can be made to the design, size, or fabric after the Lock-In Date.

3. MEASUREMENTS, SIZING, AND ALTERATIONS It is vital to understand the distinction between "Made-to-Order" and "Custom-Fit."

  • Standard Sizing: Your Made-to-Order gown is cut to the Tess Mann Atelier standard size chart that most closely aligns with the measurements you provide. It is not custom-tailored to your exact bodily dimensions prior to shipping.

  • Alterations are Expected: Because every body is unique, minor to moderate alterations are a normal, expected, and necessary part of the bridal journey to achieve a perfect fit.

  • Liability for Alterations: Tess Mann Atelier does not offer in-house alterations for online orders. All alterations are the sole financial responsibility of the customer. We are not liable for any work performed by third-party seamstresses.

  • Measurement Changes: We craft your gown based on the measurements provided at the time of your order. Tess Mann Atelier is not responsible or liable for any sizing issues that arise due to weight gain, weight loss, pregnancy, or any other bodily changes that occur after the Lock-In Date.

4. FABRIC, LACE, AND DYE LOT VARIATIONS Because our gowns are made from premium textiles, laces, and silks, slight variations in weave, embroidery placement, and dye lot can occur. These natural variations are a hallmark of luxury, handcrafted garments and are not considered manufacturing defects. Your final gown may vary slightly from digital representations on our website or physical showroom samples.

5. PRICING, PAYMENT, AND RUSH FEES

  • Payment: Full payment is required at the time of purchase for all e-commerce orders before production can begin.

  • Rush Orders: If your timeline requires expedited production, a Rush Fee will be applied to your order. Rush Fees are strictly non-refundable under any circumstances, including order cancellation.

  • Taxes & Duties: For international orders, the customer is solely responsible for any customs, import duties, and local taxes required to release the garment from customs.

6. CANCELLATION AND RETURN POLICY (FINAL SALE) Due to the highly specialized nature of Made-to-Order bridal wear, our cancellation and return policies are strictly enforced.

  • Cancellations: You may cancel your order for a full refund within 48 hours of placing it. After this grace period has passed, the gown goes into production and the order cannot be canceled or refunded.

  • Returns & Exchanges: All Made-to-Order gowns, veils, and custom accessories are Strictly Final Sale. We do not accept returns or exchanges for change of mind, wedding cancellations, or fit issues (unless a genuine manufacturing fault is identified).

  • Manufacturing Faults: In the unlikely event that your gown arrives with a verified manufacturing defect, you must contact our customer service team at sales@tessmannatelier.com within 7 days of delivery. Gowns must be unworn, unaltered, and have all original tags attached to be eligible for review by our Quality Control team.

7. SHIPPING, DELIVERY, AND FORCE MAJEURE Tess Mann Atelier provides estimated delivery windows based on current production times. However, these are estimates and not guarantees. We are not legally liable for delays resulting from events outside our reasonable control (Force Majeure), including but not limited to fabric mill delays, postal strikes, customs holds, natural disasters, or pandemics. We strongly advise ordering your gown at least 6 months prior to your wedding date.

8. INTELLECTUAL PROPERTY All designs, patterns, website imagery, logos, and copy are the exclusive intellectual property of Tess Mann Atelier. Any unauthorized reproduction, distribution, or counterfeit production of our designs is strictly prohibited and will be met with legal action.

9. DISPUTE RESOLUTION AND GOVERNING LAW These Terms and Conditions shall be governed by the laws of the State of Tennessee. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach thereof shall be settled by binding arbitration in the State of Tennessee, rather than in court.
